The EU General Data Protection Regulation (GDPR) will establish a harmonized legal framework for data protection in the EU. The objective is to once again give citizens control over their personal data and to set up strict regulations for those who store and “process” these data – all over the world. The directive thus also includes rules concerning free movement of personal data both within and outside the EU.
After four years of negotiations, the General Data Protection Regulation was ratified by the European Union in April 2016 and in the meantime it has gained legal force. In a few Member States there is, however, a two-year period for implementation into national law.
This means companies must completely adhere to the regulation from starting on May 25th, 2018.
The General Data Protection Regulation is intended to allow natural persons to have better control over the use of their personal data and set common data protection regulations for all of Europe. Within the framework of these legal changes there will be harsher penalty directives in relation to this matter.
According to the data protection regulations, people must have unrestricted access to information about data processing that is clear and understandable. Each person can submit a request in relation to this, which must be processed “without delay and within one month of submission of the request”.
